TERMS OF USE

INTRODUCTION AND ACCEPTANCE OF TERMS
By using the TUNNEL application/website (hereinafter 'Service'), you accept the following Terms. The Service is operated by TUNNEL TECH DOO (hereinafter 'TUNNEL TECH'), registered in Serbia (Company Reg. No.: 22078097, registered office: Crkvena 11, Požega). Minor users may only use the Service with parental consent.
GENERAL TERMS
By accessing and ordering Services through TUNNEL TECH, you confirm your agreement and commitment to the terms of this document. These terms apply to all TUNNEL TECH Services and all communications (email, messages, etc.) between you and TUNNEL TECH.
Under no circumstances shall TUNNEL TECH be liable for any direct, indirect, special, incidental, or consequential damages, including (but not limited to) data or profit loss, arising from the use or inability to use TUNNEL TECH Services, even if TUNNEL TECH has been advised of the possibility of such damages. Should the use of TUNNEL TECH Services necessitate servicing, repair, or correction of equipment or data, you shall bear all associated costs.
TUNNEL TECH assumes no liability for any consequences that may arise during use of our resources. We reserve the right to modify pricing and resource usage policies at any time.
LICENSE
TUNNEL TECH grants you a personal, non-exclusive, non-transferable, and limited license for non-commercial use of the Service, strictly in accordance with these Terms. These Terms constitute a contract between you and TUNNEL TECH ('we', 'our') granting a revocable license to use the services. The license is granted based on the selected subscription model (monthly/annual).
DEFINITIONS AND KEY TERMS
Cookie: A small data file generated by the website and stored by your browser. Used for identification, analytics, and preference storage (e.g., language).
Company: TUNNEL TECH with registered office at Crkvena 11, Požega, responsible for your data.
Country: Republic of Serbia, where TUNNEL TECH is registered.
User: Legal entity or individual using the services.
IP Address: Unique number assigned to a device when connecting to the internet.
Personal Data: Data enabling identification of a natural person (in accordance with GDPR and the Personal Data Protection Law of the Republic of Serbia).
USER OBLIGATIONS
You agree not to (and not to permit others to):
  1. Commercially exploit the services or platform (selling, leasing, distributing)
  2. Copy, modify, decrypt, or reverse engineer any part of the service without written Owner consent
  3. Use the Application for illegal activities or infringement of third-party rights
  4. Remove or alter copyright notices or trademarks
TERMINATION AND SUSPENSION
We reserve the right to immediately terminate or suspend access for users who:
  • Violate these Terms
  • Endanger application security or other users
  • Use the application for illegal activities
Upon account closure, the user forfeits refund rights unless otherwise agreed.
SUBSCRIPTION AND PAYMENT
Subscription is per license and may be monthly or annual.
  • Monthly license: Automatically renews each month until cancelled.
  • Annual license: Automatically renews after 12 months.
Prices are in RSD/EUR inclusive of VAT (20% for Serbia). For EU users, VAT is applied according to the user's country. Failed payments may result in license suspension.
Cancellation: Users may cancel subscriptions anytime via their account. Cancellation takes effect at the end of the current period. Refunds are not available except in legally mandated cases.
Price Changes: Prices may be changed with 30 days' prior notice via email.
REFUND POLICY
We thank you for your purchase. If dissatisfied with the product, contact us at tunnel-sales@smarty.rs.
  • Serbia: Right to refund within 14 days of purchase (Consumer Protection Law of RS). Refunds are only possible if the service hasn't been used.
  • EU: Right to full refund without justification within 14 days of purchase (Directive 2011/83/EU)
DATA PROTECTION
Personal data is processed in accordance with:
  • Personal Data Protection Law of RS
  • GDPR for EU users
Data is collected exclusively for billing and service personalization purposes.
Personal data we may process includes: IP addresses, email, traffic metadata (anonymized where possible).
All data is encrypted and stored on EU servers with adequate protection levels.
We implement SSL encryption and DDoS protection in compliance with Article 32 GDPR.
Users have the right to:
  • Access their data
  • Rectify or delete data
  • Withdraw consent
  • Lodge complaints with supervisory authorities (e.g., Commissioner for Information of Public Importance and Personal Data Protection in Serbia, or local DPA in EU)
YOUR SUBMISSIONS
All suggestions, ideas, or feedback you provide become our exclusive property. We may use them without obligation of compensation or attribution.
YOUR CONSENT
By using services, registering, or making purchases, you consent to these Terms.
LINKS TO THIRD-PARTY SITES
We assume no responsibility for content, terms, or practices of third parties. We recommend reviewing the Terms of each site.
COOKIES
We use cookies to ensure functionality, content personalization, and analytics. They contain no personal data. By using our Service, you consent to cookie usage per our Cookie Policy. Users may manage cookie settings or reject them. Disabling cookies may limit functionality.
TERM MODIFICATIONS
We reserve the right to modify Terms with 30 days' notice. Continued use constitutes acceptance of new terms.
COPYRIGHT
All content is protected under the Copyright and Related Rights Law of RS. To report infringement, provide:
  1. Copyright holder's signature
  2. Description of infringed material
  3. Your contact details
  4. Statement of good faith
LIMITATION OF LIABILITY
Services are provided 'AS IS'. Liability limited to license value (Article 492 of the Law on Obligations). We do not guarantee:
  • Uninterrupted availability
  • Data accuracy or timeliness
  • Absence of harmful software
FORCE MAJEURE
We are not liable for delays or non-performance due to extraordinary events (war, natural disasters, pandemics).
DISPUTE RESOLUTION
  1. Serbia: Disputes shall be resolved before competent courts in Požega.
  2. EU: Consumers may initiate proceedings in their home country.
  3. Arbitration: Disputes may be resolved through arbitration in Serbia (Rules of the Serbian Chamber of Commerce). Arbitration does not apply to EU consumers, who retain the right to judicial proceedings in their home country.
